Terms and Conditions

At MCF, we are committed to delivering quality products and exceptional services. To ensure you are fully informed, please review the following terms and conditions:

1. Product Descriptions and Warranties

1.1. MCF provides detailed descriptions of all products and their features. Products are warranted against manufacturing defects, and we will replace or repair any defective products within a reasonable timeframe. Customers should inspect all products upon receipt and report any defects within 24 hours.

1.2. Our installation warranty and manufacturer warranty does not cover stains, damages, scratches, or wear and tear caused by customer.

1.3. We document all completed work with photos and videos. Any defects must be reported to us within 48 hours of discovery. If, upon investigation, we determine that defects were not caused by our work, additional charges may apply.

1.4. We strongly recommend that the customer be present during the project handover to prevent any disputes or complaints.

1.5. We offer a one-year installation warranty for new carpets and floors installed by our trusted subcontractors. Our products are also backed by the manufacturers’ warranty.

1.6. Our one-year installation warranty ensures prompt resolution of installation-related issues. Products are sourced from reputable manufacturers with their own warranty, providing additional protection.

2. Product Quotes and Pricing

2.1. Quotes are valid for 10 days. MCF reserves the right to adjust pricing due to market conditions or changes in manufacturing costs. Quotes do not include installation, shipping, or other non-product related fees unless specified.

2.2. Quotes apply only to the specified products, quantities, and services. Additional products or services will be treated as variations and added to the final invoice.

2.3. Quotes are based on standard working hours. Work performed after hours, on weekends, or public holidays will incur an additional fee.

3. Payment Terms

3.1. A minimum 50% deposit is required before work commences, with the remaining balance due upon project completion. Payments can be made via cash, credit card, or check. If payment is not received within 3 days of completion, MCF reserves the right to charge interest on the outstanding balance.

4. Delivery, Sub-floor Condition, and Installation

4.1. MCF provides delivery and installation services for customers who purchase these options. Delivery times may vary based on product availability and location.

4.2. The customer is responsible for ensuring the installation area is clean and free of debris. Extra fees may apply for debris removal.

4.3. The subfloor must be level and structurally sound. Any issues with the subfloor may affect the flooring quality and longevity. If the customer opts out of our preparation or leveling services, they assume full responsibility for defects caused by an uneven floor.

5. Cancellation Policy

5.1. To cancel an order, notify MCF in writing before the order is placed. Cancellations made after this period incur a fee equal to 30% of the total order cost for flooring products.

5.2. Carpet orders cannot be canceled once cut. If canceled, MCF reserves the right to charge a restocking fee of 70% of the total order cost.

6. Returns and Refunds

6.1. Returns are subject to a 30% restocking fee. MCF does not offer refunds on installed products or products that have been altered.

7. Limitation of Liability

7.1. MCF is not liable for damage to property or persons resulting from the use or installation of our products, except for damage caused by our own negligence. We are not liable for indirect, incidental, or consequential damages.

8. Commercial Projects Payment Terms

8.1. For commercial projects, a 50% deposit is required at contract signing. The remaining 50% of the contract amount, plus any variations, must be paid before project handover.

9. Customer Responsibilities

9.1. The customer must ensure:

  • Electricity is connected at the installation site.
  • Necessary approvals are obtained from the body corporate or building manager.
  • The lift is booked for use during installation.
  • The car park is provided/booked for installers
  • The customer must ensure the work area is fully vacated before the installers arrive. If this is not done, two options are available:
    1. We will provide a quote for furniture removal. If the customer does not accept this, the second option will be applied.
    2. We will reschedule the project, and rescheduling fees will be charged based on the number of contractors assigned to the job.

10. The condition of the sub-floor
As a flooring contractor, we offer two options for addressing uneven subf-loors:

  1. Floor Preparation – a cost-effective option
  2. Floor Leveling – a more comprehensive, higher-cost option

Definition of Floor Preparation

Floor Preparation involves the process of cleaning, flattening, and priming the subfloor to ensure it is ready for the installation of new flooring. This step addresses uneven surfaces, removes debris, and ensures that the subfloor is in suitable condition to support the flooring material. Floor preparation does not guarantee that the entire surface will be leveled but ensures it is stable and smooth enough for installation.

Definition of Floor Leveling

Floor Leveling is the process of bringing the entire floor in a property to the same level. This involves correcting significant unevenness in the subfloor by using leveling compounds or other materials to fill in low spots and create a uniform, flat surface. This ensures that the flooring sits evenly throughout the space, preventing potential issues such as gaps, buckling, or uneven wear.

By selecting one of these services, the customer confirms they fully understand the differences and accepts responsibility for their choice. If the customer decides not to proceed with either service or hires another team for these services, MCF will not be held liable for any issues caused by the uneven subfloor, and the one-year flooring or carpet installation warranty will be void.

11. Dispute Resolution

11.1. Any disputes or claims arising from MCF’s products or services shall be resolved through arbitration in accordance with the rules of the VCAT/Magistrates Court of Victoria.
